Effective date: 2 August 2026
Last updated: 2 August 2026
Please read these Terms of Service carefully before using the Arcla platform. These Terms form a legally binding agreement between you and Arcla Ltd.
1. About Arcla
Arcla is an online marketplace operated by Arcla Ltd (referred to as “Arcla”, “we”, “us”, or “our”). We are incorporated in New Zealand. Arcla connects independent contractors with companies that require skilled trades workers, and also allows job seekers to find wage-based employment opportunities.
Our primary contact for general enquiries is: info@arcla.co.nz.
2. Acceptance of Terms
By creating an account, accessing, or using the Arcla platform (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform.
These Terms apply to all users, including contractors, companies, and job seekers. Where separate provisions apply to a specific user type, that is noted clearly.
We may update these Terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.
3. Eligibility
To use Arcla, you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into binding contracts under New Zealand law;
- Provide accurate, complete, and current information during registration and keep it updated; and
- Not be prohibited from using the Platform under any applicable law.
By registering as a company, you represent that you have authority to bind the business entity on whose behalf you are registering.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@arcla.co.nz if you suspect unauthorised access.
You may not share your account or transfer it to another person. Each account is personal to the registered user or the business entity registered.
5. Contractor Terms
As a contractor on Arcla, you agree to:
- Only submit qualifications, licences, and documents that are genuine and accurate;
- Keep your Arcla Passport up to date, including notifying us promptly of any expired or revoked credentials;
- Not misrepresent your skills, experience, or availability to companies;
- Honour commitments made to companies through the Platform in good faith; and
- Comply with all applicable New Zealand laws relevant to your trade, including health and safety obligations.
Arcla verifies uploaded documents manually. Verification does not constitute an endorsement of your fitness for any particular role. Companies make their own hiring decisions.
Your basic profile may be public if you choose. Your Arcla Passport and profile may be visible to eligible companies searching the platform. You control which information is displayed through your privacy settings.
6. Company Terms
As a company on Arcla, you agree to:
- Only post legitimate job opportunities and respond to applicants in good faith;
- Not use contractor profiles or personal information obtained through the Platform for purposes other than legitimate hiring decisions;
- Comply with all applicable New Zealand employment and health and safety law when engaging contractors; and
- Pay any applicable fees in accordance with our Subscription & Cancellation Policy when paid plans are made available.
Arcla is a marketplace and is not a party to any contract entered into between a company and a contractor. Arcla does not guarantee the suitability, availability, or performance of any contractor listed on the Platform.
7. Arcla Passport
The Arcla Passport is a digital work profile maintained for contractors on the Platform. Verification is performed manually by Arcla administrators.
Arcla does not guarantee that all credentials displayed on an Arcla Passport have been independently verified with issuing bodies. Companies should undertake their own due diligence where required.
Arcla Verified status (“Arcla Verified”) indicates that submitted documents have passed Arcla’s internal review. It is not a guarantee of legal compliance or fitness for a specific role.
8. Prohibited Conduct
You must not:
- Submit false, misleading, or fraudulent information;
- Impersonate any person or entity, or misrepresent your affiliation;
- Use the Platform to harass, abuse, or harm others;
- Attempt to circumvent any security feature or access controls;
- Scrape, copy, or otherwise extract data from the Platform without our written consent;
- Use the Platform for any unlawful purpose; or
- Post spam, unsolicited promotions, or unrelated content.
Breach of these provisions may result in immediate account suspension or termination.
9. Intellectual Property
All content on the Platform, including the Arcla name, logos, design, and software, is owned by or licensed to Arcla Ltd and is protected by New Zealand and international intellectual property laws.
By uploading content to the Platform (such as profile information, qualifications, and job listings), you grant Arcla a non-exclusive, royalty-free licence to display and use that content for the purpose of operating the Platform.
You retain ownership of content you upload. You represent that you have the right to upload it and that it does not infringe any third-party rights.
10. Paid Plans
